That distinction is essential. A society can disapprove of conduct without criminalizing it. Citizens are free to criticize speech, ignore it, condemn it, or respond with speech of their own. The state, however, possesses powers that ordinary individuals do not. It can arrest, detain, search, prosecute, and punish. Because those powers are so significant, constitutional limits are meant to prevent their misuse.
In the end, Webb walked away with the charges against him dropped. But the episode remains a cautionary tale. The danger to liberty rarely arrives with dramatic declarations or sweeping announcements. More often, it emerges through small decisions made in ordinary moments—moments when someone assumes a right is too insignificant to defend or too unpopular to deserve protection.
